
This is one of the provisions in the draft revised Law on Cadres and Civil Servants, which the Government has submitted to the National Assembly for review and discussion.
The draft law has removed certain provisions in existing law regarding groups eligible for recruitment through an evaluation.
That is, individuals recruited as civil servants through evaluations no longer need to belong to certain groups, including those committing to work for at least five years in areas with particularly difficult socio-economic conditions; those trained under the nomination system who return to work in the locality that sent them to training courses; or outstanding graduates and young talented scientists.
In general, basic provisions of the current law remain unchanged, which means that agencies will recruit civil servants through three ways: competitive examinations, evaluations, or direct recruitment.
No direct recruitment for certain groups
However, for direct recruitment, the draft law introduces a new regulation. This direct recruitmemt method will only apply to recruitment of talented individuals from the non-public sector or those with experience who immediately meet the requirements of the civil servant position, including civil servants, individuals receiving salaries in the People’s Army, People’s Police, cryptographic organizations (but not civil servants), and other individuals working in agencies, organizations, or units within the political system.
This means that civil servants working in public service units and commune-level cadres and civil servants will not be directly recruited. Individuals who were previously cadres or civil servants and were later assigned or rotated by competent authorities to positions that are not cadre or civil servant roles in other agencies or organizations must undergo competitive examinations or evaluations if they wish to apply for civil servant positions again.
Under current law, individuals eligible for transfer as civil servants include those holding positions such as chairman of the member council, chairman of the board of directors, company chairman, member of the member council, member of the board of directors, controller, general director, deputy general director, director, deputy director, chief accountant, and others holding management positions or titles as stipulated by the Government in state-owned enterprises or enterprises where the State holds more than 50 percent of charter capital. These individuals must be planned for appointment to the position or an equivalent role.
However, in the draft revised law, these individuals will no longer be eligible for direct recruitment.
In Article 25, the draft law stipulates that civil servant management agencies may sign fixed-term contracts with experts, scientists, or individuals meeting professional and technical requirements to perform certain tasks for specialized civil servant positions.
