Le Van Hai is arrested for investigation of the crime of "Trading counterfeit goods as food"

The agency is investigating Le Van Hai, 29, residing in Ninh Binh, the owner of the TikTok channel "Hai Sen Family," a capital contributor of Hai Be Co, Ltd., for "trading counterfeit food".

The Investigation Agency has determined that since 2024, Hai Be has sold over 800,000 products through social media platforms such as TikTok Shop, Facebook, and Shopee under the accounts "Hai Sen Family" and "Hai Sen." Over 100,000 boxes of "Hai Be Delicious Syrup" were sold on the market.

Quality testing results for "Hai Be Delicious Syrup" showed that the main active ingredients, including Vitamin A, Calcium, and Vitamin C, were below 70 percent of the declared content, qualifying the product as "counterfeit" under current regulations.

The product was manufactured by a facility based in LuongSon District, HoaBinh Province (prior to province merger). This unit is part of a large-scale system producing various functional foods and milk for children, with revenues amounting to tens of trillions of VND. 

The company’s self-declared quality documents claimed all standards were met, but the claims contradicted the authorities’ test results.

According to Lieutenant Colonel Do Hai Luong from Ninh Binh Provincial Police, the manufacturing unit held a GMP certification, meaning it had a laboratory meeting standards. But all product batches were self-tested by the manufacturer.

The people involved in the case admitted to earning profits of VND300–400 million per month from trading counterfeit goods. Each packet of "Hai Be Delicious Syrup" cost about VND40,000 to produce but was sold on the market at double the price.

Le Van Hai, the owner of the TikTok channel "Hai Sen Family," stated: "I trusted the manufacturer too much. Only after the authorities’ inspection did I realize the issue and stopped selling. It all happened due to a lack of understanding."

The investigation revealed signs of tax evasion, with actual revenue exceeding VND100 billion per year, while tax reports consistently showed losses.

Following the Ministry of Public Security and Ninh Binh Provincial Police’s directives to launch a crackdown on smuggling, commercial fraud, production, and trading of counterfeit goods, and intellectual property violations, the Economic Police Division implemented measures to detect and strictly handle violations.

The police discovered that the TikTok account "Hai Sen Family," owned by Le Van Hai, frequently posted videos selling cosmetics and functional foods, including the health supplement "Hai Be Delicious Syrup."
