
National Assembly Chairman Tran Thanh Man has signed the resolution, which sets forth specific measures to resolve legal and administrative challenges concerning these projects and land disputes.
The resolution also seeks to address 1,313 cases of expired land use rights in Da Nang, where land use certificates and property ownership documents were issued beyond the legal timeframe.
According to the resolution, all inspection and audit conclusions and legally binding court rulings must be strictly enforced. Authorities will only review and resolve difficulties in cases where violations resulted from the errors of state management agencies or from shared mistakes by both government agencies and investors.
Additionally, legal obstacles will only be removed for projects where violators - whether organizations or individuals - have been strictly dealt with according to Party and state laws, and where economic consequences have been rectified, including the recovery of financial benefits gained from violations.
For projects and land disputes still under criminal proceedings, the National Assembly specifies that the special mechanism will only be applied after a legally binding court ruling or a decision to dismiss the case.
The resolution also emphasizes that implementation must ensure clear delegation of responsibilities, prevent the legalization of past violations, and avoid new violations. Authorities are required to closely monitor and strictly handle any individuals or organizations exploiting the resolution for corruption or misconduct.
Special measures for dozens of projects
The resolution provides detailed guidelines for resolving land use, valuation, land-use fee calculations, and lease payments for 13 projects in Da Nang identified in the Government Inspectorate’s Conclusion No. 269 dated September 16, 2019.
Similarly, it sets forth mechanisms for determining land prices and rental fees for 16 projects in Da Nang as per Conclusion No. 2852 issued on November 2, 2012.
Additionally, the resolution mandates the review and correction of land use certificates for 20 cases in Da Nang identified in Conclusion No. 2852.
In Khanh Hoa, the National Assembly has decided on measures regarding land use, pricing, and rental fees for 11 projects listed in Conclusion No. 250 dated September 11, 2020.
For Ho Chi Minh City, the resolution addresses the legal treatment of the project at 39 - 39B Ben Van Don, as detailed in Conclusion No. 757 dated May 13, 2021.
Furthermore, three projects with violations cited in the Government Inspectorate’s Report No. 332, issued on December 9, 2020, will undergo review for land valuation and fee calculations.
With this resolution, a total of 64 projects with legal entanglements in Ho Chi Minh City, Da Nang, and Khanh Hoa have been granted a special mechanism for resolution.
The resolution will take effect on April 1, 2025.
